Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Dress Smart Pvt. Ltd. ("Dress Smart", "we", "us") governing your use of the Dress Smart website (dresssmart.com.np) and mobile application (together, the "Services") and your purchase of garments through them. By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old (or the age of majority in your jurisdiction), or use the Services under the supervision of a parent, guardian or authorized organization.

You are responsible for the accuracy of the information in your account and for keeping your login credentials confidential. You are responsible for activity that occurs under your account. Tell us promptly if you believe your account has been compromised.

All garments are made to order against the measurements and specifications you provide. Please review your measurements and customizations carefully before confirming — production begins once your order is confirmed and payment is verified.

Because items are custom-made to your measurements, they are produced specifically for you and cannot be resold; made-to-measure items are therefore not eligible for change-of-mind returns. Your statutory consumer rights and our Fit Guarantee (below) are unaffected.

Prices are quoted in Nepalese Rupees (NPR) and confirmed at order time, including any customization charges and volume discounts.

You may pay online through eSewa, Fonepay or PayPal, or by bank deposit, which our team verifies before production begins. We may cancel or hold an order if payment cannot be verified.

You may cancel or revise an order free of charge before production starts (while the order is in the Confirmed stage). Once cutting has begun, cancellation is no longer possible; instead our team will help with alterations after delivery.

If a garment does not fit despite accurate measurements, we will alter it free of charge within 14 days of delivery. Garments are identified by their serial number for all post-sales service.

Delivery timelines are estimates and depend on production load and the shipping partner. You can track every stage of production and shipment from your account. Risk of loss passes to you on delivery to the address you provide.

Vouchers apply once per order, subject to their stated minimum order value and validity dates. Loyalty points are earned on completed payments and may be redeemed according to the program rules shown in your account. We may change or end promotional programs prospectively.

You agree not to misuse the Services: no unlawful, infringing or fraudulent activity; no attempts to breach security, access other users' data, scrape or overload the Services, or interfere with their operation; and no uploading of content you do not have the right to share.

The Services, including the Dress Smart name, designs, software and content, are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable licence to use the Services for their intended purpose. You retain rights to the content and measurements you provide, and grant us the licence needed to fulfil your orders and operate the Services.

The Services are provided on an "as is" and "as available" basis. AI-assisted measurement is a convenience that estimates values from your input and should be reviewed before you confirm an order; we do not warrant that it is error-free. To the extent permitted by law, we disclaim implied warranties not expressly stated here.

To the extent permitted by law, our total liability arising from an order is limited to the value of the garments in that order. We are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited by law, or your rights under the applicable consumer law of Nepal.

You may stop using the Services and request account deletion at any time (see the Privacy Policy). We may suspend or terminate access if you breach these Terms or to protect the Services and other users. Terms that by their nature should survive — such as payment obligations, intellectual property and limitation of liability — survive termination.

These Terms are governed by the laws of Nepal, and disputes are subject to the courts of Nepal, without prejudice to any mandatory consumer protections available to you.

We may update these Terms from time to time. We will post the updated version here with a new effective date, and continued use of the Services after an update means you accept the revised Terms.
